Listoria Terms of Service

§ 1. General provisions

These Terms of Service govern the use of the Listoria online service available at listoria.app (the “Service”). The Service is operated by Listoria, conducting unregistered economic activity under Article 5(1) of the Polish Entrepreneurs’ Law Act of 6 March 2018 (the “Provider”). Contact: kontakt@listoria.app.

Using the Service constitutes acceptance of these Terms. If you do not accept them, please do not create an account or use the Service.

§ 2. Definitions

  • User — a natural person who has created an account in the Service.
  • Account — the User’s individual profile secured by an email address and password.
  • Free plan — the no-cost tier of the Service, subject to limits described on the pricing page.
  • Pro plan — the paid subscription tier without quantitative limits.
  • Stripe — Stripe Payments Europe, Limited, the payment processor handling all payments and subscriptions in the Service.

§ 3. Scope of the Service

The Service is an online tool for interior designers to create shopping lists, cost estimates, moodboards and to communicate with clients. The full feature list is available on the Service homepage and pricing page.

The Service is provided electronically 24/7. The Provider reserves the right to short technical maintenance windows.

§ 4. Technical requirements

  • A current version of a web browser (Chrome, Safari, Firefox or Edge).
  • An active internet connection.
  • An active email address.
  • JavaScript and cookies enabled.

§ 5. Registration and account

Creating an account requires providing an email address and setting a password, or signing in with a Google account. The User agrees to provide accurate information and to keep their password confidential.

The User may delete their account at any time from the Service settings or by emailing kontakt@listoria.app.

§ 6. Plans and payments

The Free plan is free of charge and does not require payment details.

The Pro plan is a paid subscription (monthly or annual) at the prices listed at listoria.app/en#pricing. Prices include all legally required charges (the Provider is not a VAT taxpayer).

Payments are processed by Stripe. Accepted methods: credit/debit cards (Visa, Mastercard) and BLIK. Subscriptions renew automatically until cancelled by the User.

§ 7. Cancellation

The User may cancel the Pro subscription at any time via the Stripe customer portal (available in Account settings → Subscription) or by emailing kontakt@listoria.app.

After cancellation, the User retains access to Pro features until the end of the paid billing period. No automatic prorated refunds are issued for the current period, unless mandatory law provides otherwise.

§ 8. Right of withdrawal

Consumers have the right to withdraw from a distance contract within 14 days without giving a reason (Polish Consumer Rights Act of 30 May 2014, implementing Directive 2011/83/EU). To exercise this right, email kontakt@listoria.app.

Note: under Article 38(13) of the Consumer Rights Act, the right of withdrawal does not apply where the digital service has begun with the consumer’s prior express consent and after being informed of the loss of the right. By creating an account and starting to use the Pro plan within 14 days, the User provides such consent.

§ 9. Complaints

Complaints regarding the Service may be sent to kontakt@listoria.app. A complaint should contain the User’s data (account email), a description of the issue, and the requested resolution. Complaints will be answered within 14 business days.

§ 10. Liability

The Provider makes reasonable efforts to keep the Service operational but does not guarantee uninterrupted availability. The Provider is not liable for damages caused by Service downtime, by data loss resulting from third-party action, or for business decisions taken by the User based on data from the Service.

The above limitations do not exclude or limit any rights of consumers under mandatory provisions of law.

§ 11. Intellectual property

All rights to the Service (name, logo, code, design, editorial content) belong to the Provider. Content submitted by the User (projects, lists, moodboards, images) remains their property; the Provider processes it solely for the purpose of providing the Service.

§ 12. Out-of-court dispute resolution

Consumers are entitled to use out-of-court complaint and redress procedures, including the European Commission’s ODR platform: ec.europa.eu/consumers/odr.

§ 13. Changes to the Terms

The Provider may update these Terms for valid reasons (changes in law, scope of services, payment methods). Users will be notified by email at least 14 days in advance. Continued use of the Service after that date constitutes acceptance of the changes.

§ 14. Final provisions

Matters not regulated by these Terms are governed by Polish law, in particular the Civil Code, the Consumer Rights Act and the Act on Providing Services by Electronic Means.
